Terms of Service

These Terms of Service ("Terms") govern your use of the Albusto software platform, websites and related services (the "Service"). The Service is operated by ABC Homes LLC, a Massachusetts limited liability company ("Albusto", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent.

1. The Service

Albusto is business management software for field service companies. Depending on your plan, it provides tools including a unified communications inbox (calls, SMS, email), an AI-powered virtual receptionist, lead and job tracking, scheduling and dispatch, estimates and invoicing, and online payment collection.

2. Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for all activity under your account and for keeping credentials secure. The Service is intended for business use by companies and their staff, not for personal consumer use.

3. Subscriptions and billing

The Service is offered on monthly subscription plans, plus usage-based charges for calls, text messages and similar metered features as described on our pricing page and in your account's billing settings. Fees are billed in U.S. dollars, in advance for the subscription and in arrears for metered usage, to the payment method on file. Payments are processed by Stripe; we do not store your full card details. Prices may change with at least 30 days' notice, effective at your next billing cycle.

4. Cancellation and refunds

You may cancel your subscription at any time from your billing settings or by emailing support@albusto.com. There are no long-term contracts or early termination fees. Cancellation and refund terms are described in our Refund & Cancellation Policy, which is part of these Terms.

5. Telephone and messaging compliance

The Service lets you place calls, record calls, and send SMS messages. You are responsible for using these features lawfully, including obtaining any consents required for call recording and text messaging in your jurisdiction (for example under the TCPA and applicable state two-party consent laws), and for honoring opt-out requests. You may not use the Service to send spam or unlawful robocalls.

6. Your data

You retain ownership of the customer records, communications and other content you store in the Service ("Customer Data"). You grant us a limited license to host and process Customer Data solely to provide and improve the Service. We handle personal information as described in our Privacy Policy. You can export your Customer Data, and you may request its deletion when your account closes.

7. Acceptable use

You agree not to misuse the Service — including attempting to breach its security, reselling it without authorization, interfering with other customers, or using it for any unlawful, deceptive or fraudulent activity.

8. Third-party services

Parts of the Service rely on third-party providers (for example Stripe for payments and telephony carriers for calls and SMS). Their availability may affect the Service, and their own terms apply to their processing of your transactions.

9. Disclaimers and liability

The Service is provided "as is". We work hard to keep it available and accurate, but we do not warrant uninterrupted or error-free operation, and AI-generated content (such as call summaries or receptionist conversations) may contain mistakes — please review important items. To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential damages.

10. Termination

We may suspend or terminate accounts that materially violate these Terms, with notice where practicable. On termination, we will make your Customer Data available for export for at least 30 days unless the law requires otherwise.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Suffolk County, Massachusetts.
